A Superior Court judge has raised the bail amount for a man charged with child rape, as announced by Plymouth County District Attorney Timothy Cruz.
Details of the Hearing
During a hearing that lasted over an hour on Monday in Brockton Superior Court, Judge Elaine Buckley approved the Commonwealth’s motion, setting cash bail for 26-year-old Cory B. Alvarez at $150,000, with no surety. Alvarez faces serious charges, including Aggravated Rape of a Child with a 10-Year Age Difference and Rape of a Child by Force. The Commonwealth had originally requested a $1,000,000 bail with conditions.
In their motion, the Commonwealth expressed concerns that without a bail increase, Alvarez—a claimed citizen of Haiti currently in the U.S. under the Cuban, Haitian, Nicaraguan, and Venezuelan Parole Program—would be removed from the country on October 31, 2024. This deportation would prevent him from facing the charges against him, thereby halting the case indefinitely and denying justice for both the alleged victim and the defendant.
Background of the Charges
The charges against Alvarez arose from an investigation conducted by the Rockland Police Department. On March 13, 2024, at approximately 7:06 p.m., officers responded to a report of a sexual assault at the Comfort Inn located at 850 Hingham Street, which is part of a state/federal program housing migrant families. Alvarez was residing at the hotel.
Upon arrival, police encountered a 15-year-old female victim, who was subsequently taken to South Shore Hospital for medical treatment. Following their investigation, Rockland Police established probable cause to arrest Alvarez.
Previous Legal Proceedings
In June, a two-day dangerousness hearing was held in Brockton Superior Court, where a judge determined that Alvarez was not a danger to the community and set bail at $500 cash. Alvarez posted this bail the same day and was released, despite the Commonwealth’s request for a higher bail amount of $10,000 with conditions.
However, on August 13, during his next pretrial conference, U.S. Immigration and Customs Enforcement (ICE) took Alvarez into custody based on an ICE detainer. Since then, he has been held in the ICE Unit at the Plymouth County House of Corrections.
Documentation from immigration proceedings revealed that Alvarez was found removable and inadmissible by the immigration court. Following his admissions, the court ruled that he was removable as charged, which he chose not to appeal.
On October 4, a warrant for Alvarez’s deportation was issued, and on October 24, ICE officials notified the Commonwealth that they intended to deport him back to Haiti on October 31.

Commonwealth’s Request for Bail Increase
In response to the imminent deportation, the Commonwealth filed a request for a hearing to increase Alvarez’s bail last Friday. During the hearing, Judge Buckley stated, “The Commonwealth does have a case of strength. The court finds justice requires the increase in bail.”
Alvarez is scheduled to appear in court again on November 13 for a discovery status hearing.
